MoldCo Consumer Health Data Privacy Policy

This policy applies to your (" you" or " Consumer") personal data as defined by the Washington My Health My Data Act (" MHMDA") that is collected, used, stored, and shared by The Immune Co. d/b/a MoldCo ("MoldCo" or "we").

Consumer Health Data is defined by the MHMDA as personal information that identifies or can reasonably be used to identify a person's past, present, or future physical or mental health status. We maintain a general Privacy Policy ( /legal/privacy), accessible on the MoldCo website, that covers collection, use, storage, and sharing of all personal and health information.

This policy applies if you are a Washington resident, or if your consumer health data is collected while you are within Washington. It does not apply to any information you provide in an employment context. This policy applies to all Consumer Health Data that MoldCo collects, including health information you provide us during information-gathering and intake processes, diagnosis, test, and laboratory results, medications, treatment records, inferences MoldCo may draw from the provided health information, identifiers MoldCo's websites collects, and payment information that indicates you sought health services.

Data Collection Sources

MoldCo collects health data directly from you, including intake forms, messages, and conversations with our staff and clinicians. Additional data is collected from (1) Consumers' browser or device when using all MoldCo websites, (2) clinicians or laboratories you authorize to share with us, and (3) contracted service providers acting on MoldCo's behalf.

Sharing of Consumer Health Data

MoldCo shares Consumer Health Data only after obtaining Consumer consent or where necessary to provide care you requested.

MoldCo does not sell Consumer Health Data.

MoldCo shares Consumer Health Data with (1) clinicians and health care providers who deliver your care and with your consent, including clinicians, laboratories, testing partners, and pharmacies, (2) payment processors, (3) contracted technology providers that host, secure, and operate MoldCo websites, (4) analytics and consent-management providers, and with your consent, (5) if and as required, government agencies, courts, and other parties required by law.

Consumer Rights

You have the right to:

  • Confirm and access Consumer Health Data: You may request MoldCo states whether we are collecting, sharing, or selling your Consumer Health Data. You may request a copy of any Consumer Health Data possessed by MoldCo. MoldCo maintains third-party affiliates and subcontractors with which Consumer Health Data may be shared, consistent with the purposes and scope described in this policy. You may request a full list of any third-party affiliate and subcontractor with which MoldCo shares your Consumer Health Data.
  • Withdraw consent: You have the right, at any time, to withdraw your consent to MoldCo's collection of your Consumer Health Data. You have the right, at any time, to withdraw your consent to MoldCo's sharing of your Consumer Health Data.
  • Deletion: You have the right to request deletion of your Consumer Health Data.

How to make a request

You may contact MoldCo to request any of these actions. Your request must include your full name and contact information, description of which right(s) you wish to exercise, and any additional details that will assist us in responding to your request.

Decision and Appeal

MoldCo will verify your identity and respond within forty-five (45) days. If MoldCo denies any request, you may appeal the decision. Appeals must contain a copy of the original decision, an explanation of why you believe the denial was incorrect, and include any supporting documentation you wish to be reviewed. MoldCo will respond within forty-five (45) days. Should your appeal be denied, you may file with the Washington Attorney General at www.atg.wa.gov/file-complaint.

Changes to this policy

MoldCo reserves the right to update or amend this policy or MoldCo's general Privacy Policy. If those changes are material, MoldCo will inform you by posting notice on its website. If MoldCo decides to collect, use, or share Consumer Health Data in a type or manner that is not included in this policy, MoldCo will obtain your consent prior to doing so.

Clinical services are provided by a network of independent providers including, without limitation, an affiliated clinical practice, Immune Co Medical Group P.A., and its related professional entities which are independent entities. MoldCo is a healthcare technology company and not a laboratory or medical provider. We make available certain products and services sold or offered by MoldCo and/or by affiliated practices, third-party licensed clinicians, participating pharmacies, CLIA-certified laboratories (collectively, the "Providers"), or other vendors. Any services you receive from the Providers or other vendors may be subject to additional terms and conditions from those Providers or vendors. All laboratory and medical services are provided to individuals who register as members by independent third parties such as the Providers or other vendors. These Providers and other vendors set their own pricing.

Although MoldCo may facilitate easy access to certain laboratory and medical service providers on your behalf, MoldCo does not recommend or refer you to any healthcare providers, and you are free to choose any healthcare provider and continue to use MoldCo's services. MoldCo does not offer medical advice, laboratory services, a diagnosis, or any form of medical opinion, through our services or otherwise. MoldCo's pricing includes technology and service fees charged by MoldCo, as well as access to limited prepaid laboratory and other services provided by third parties, and paid to such third parties on your behalf. Certain products available through our website located at www.MoldCo.com together with all of its sub-domains and mobile-enabled websites (the "Platform") require a valid prescription by a licensed healthcare provider. You will not be able to obtain a prescription product unless you have completed a consultation with one of the Providers through the Platform or in person as may be required by federal or state laws, the Provider has determined the prescription product is appropriate for you and the Provider has written a prescription. If a Provider determines a prescription product is appropriate for you and writes a prescription, you may fill it through one of the Pharmacies by using the Platform. If you complete a consultation with a Provider and fill a prescription through one of the Pharmacies, the prescription product will be shipped to you by the applicable Pharmacy.
