MoldCo respects your privacy and values your trust. This Privacy Policy governs our website and the use of the products, offerings, features, tools, and resources that we provide. As used in this Privacy Policy, “Moldco,” “we,” “us,” and “our” refer to The Immune Co, d/b/a Moldco, together with its affiliates and subsidiaries. The Privacy Policy explains how we collect your personal information, how we use, disclose, and protect personal information, and the choices you have concerning the use of your personal information. 

Please read this Privacy Policy carefully. By accessing and/or using ourService, or Platform, you agree to the most recent version of this Privacy Policy. If you do not agree with the terms of this Privacy Policy and our Terms & Conditions, then you should immediately discontinue use. We will update this Privacy Policy when necessary to reflect material changes in the Service or how we use personal information, and as required by applicable law. If we make any changes to our Privacy Policy, we will post the revised Privacy Policy and update the “Last updated” date at the top of the Privacy Policy. If we make material changes to this Privacy Policy, we will provide notice or obtain consent regarding such changes as may be required by law.

If you are using the Service on behalf of an individual other than yourself, you represent that you are authorized by such an individual to act on such an individual's behalf and that such individual acknowledges the practices and policies outlined in this Privacy Policy.


Protected Information

When you set up an account with Moldco, you are creating a direct customer relationship with Moldco that enables you to access and/or utilize the various functions of the Platform and the Service as a user. As part of that relationship, you provide information to Moldco, including but not limited to, your name, email address, shipping address, phone number and certain transactional information, which we do not consider to be “protected health information” or “medical information.”

However, in using certain components of the Service, you may provide certain health or medical information that may be protected under applicable laws. Moldco is not a “covered entity” under the Health Insurance Portability and Accountability Act of 1996, Public Law 104-191, and its related regulations and amendments from time to time (collectively, “HIPAA”). One or more of the Labs, Pharmacies or Medical Groups (as defined in our Terms and Conditions) may or may not be a “covered entity” or “business associate” under HIPAA, and Moldco may in some cases be a “business associate” of a Pharmacy or Medical Group. It is important to note that HIPAA does not necessarily apply to an entity or person simply because there is health information involved, and HIPAA may not apply to your transactions or communications with Moldco, the Medical Groups, the Providers, the Labs, or the Pharmacies. To the extent Moldco is deemed a “business associate” however, and solely in its role as a business associate, Moldco, may be subject to certain provisions of HIPAA with respect to “protected health information,” as defined under HIPAA, that you provide to Moldco, the Medical Group or the Providers (“PHI”). In addition, any medical or health information that you provide that is subject to specific protections under applicable state laws (collectively, with PHI, “Protected Information”), will be used and disclosed only in accordance with such applicable laws. However, any information that does not constitute Protected Information under applicable laws may be used or disclosed in any manner permitted under this Privacy Policy. Protected Information does not include information that has been de-identified in accordance with applicable laws.The Medical Groups and Providers have adopted a Notice of Privacy Practices that describes how they use and disclose Protected Information. By accessing or using any part of the Service, you acknowledge receipt of the Notice of Privacy Practices from your Medical Group and Provider(s).

By accessing or using any part of the Service, you understand that any information that you submit to Moldco that is not intended and used solely for the provision of diagnosis and treatment by the Medical Group and Providers, laboratory services by the Labs or prescription fulfillment by the Pharmacies, is not considered Protected Information, and will be subject only to our Privacy Policy and any applicable state laws that govern the privacy and security of such information. For purposes of clarity, information you provide to Moldco in order to register and set up an account on the Platform, including name, date of birth, username, email address, shipping address, and phone number, are not considered Protected Information.

INFORMATION WE COLLECT

The personal information we collect depends on how you interact with us, the services you use, and the choices you make. We collect personal information about you from different sources and in various ways when you use our services, including information you provide directly, information collected automatically, information from third-party data sources, and data we infer or generate from other data. When you are asked to provide your personal information, you may decline or use browser or device controls to prevent certain types of data collection. In some cases, if you choose not to provide personal information that is necessary, some services may not be available to you.

Information you provide

When you complete the MoldCo Questionnaire (“MoldCo Home & Health Questionnaire”), order a product from us, request information from us, engage with our providers, or otherwise engage with our Platform and Services,  you share certain personal information such as:

  • Identifiers and contact information: Depending on the Moldco service you use, we may collect your name and contact details such as email address, postal address, and phone number.
  • Demographic data: your age, gender, and information about your environment.
  • Social plug-ins, such as third-party websites, networks, platforms, servers and/or application information (e.g., Facebook, Twitter, Instagram).
  • Communications: If you send us email messages or communications (such as photographs, videos, documents, and other files), we may collect and retain those communications.

Sensitive Personal Information:

  • Government ID. We may collect government-issued identifiers such as driver’s license, passport number, and social security numbers. 
  • Sensitive demographic data. We collect information about racial or ethnic origin. 
  • Account access information: If you create an account with us, we collect the credentials that allow access to your account.
  • Contents of communications. We collect the contents of communications that you make via the Service.
  • Biometric information. We or our service providers may use biometric information to verify your identity prior to your use of Moldco services.
  • Health data: we collect and analyze information concerning your health, such as your diagnosed diseases and medical conditions, blood test abnormalities, and physical symptoms and information relating to your browsing activity, purchases, and other interactions on our site .
  • Payment information: If you make a purchase from our website, we collect your credit card number and other payment details.

In some states, we may be required to obtain your consent prior to using information that constitutes sensitive personal information. While we may use information about your browsing activity on health-related pages, we do not use Protected Information for advertising or marketing.

Information collected automatically

When you use our website, certain Internet and electronic network activity information gets created and logged automatically. Here are some of the types of personal information we collect:

  • Usage and log data: Our servers record information (“log data”) that your browser automatically sends whenever you visit a website, including your IP address, browser type and settings, the date and time you accessed our website, the URL of the website from which you came to our site, pages you viewed, how long you spent on a page, and other details about your use of and actions on our website.
  • Cookie data: We use cookies, web beacons, mobile analytics and advertising device IDs, and similar technologies on our website to collect personal data (such as the pages you visit, the links you click on, and similar usage information, identifiers, and device information).   • Geolocation data. Depending on your device and web settings, we collect geolocation data when you use our online services.

Inferences we create or generate

We infer new personal information from other data we collect, including using automated means to generate information about you. For example, we may infer your likelihood of mold-related illness based on the information you provide in the MoldCo Questionnaire and we may infer your general geographic location (such as city, state, and country) based on your IP address.

Information collected from third-party services

We also obtain the types of personal information described above from third parties. These third-party sources include, for example:

  • Third-party partners: Third-party applications and services, including social networks you choose to interact with to connect to our services. What we have access to depends on the privacy policies or settings for those accounts.
  • Information our advertisers share with us: We may get information about you and your activity from our advertising partners and other third parties we work with. For example, online advertisers or third parties share personal information with us to measure, report on, or improve the performance of ads for Moldco.
  • Co-branding/marketing partners: Partners with which we offer co-branded services or engage in joint marketing activities.
  • Service providers: Third parties that collect or provide data in connection with work they do on our behalf. 
  • Publicly available sources. Public sources of information such as open government databases.

When you are asked to provide personal information, you may decline. And you may use web browser or operating system controls to prevent certain types of automatic data collection. But if you choose not to provide or allow information that is necessary for certain services or features, those services or features may not be available or fully functional.

MoldCo provides management services to the medical providers and certain pharmacies you may access through the Service. As a result, we may store additional health information on their behalf, including your medical record, communications with providers, medical history, and prescription information.

Deidentified and Aggregated Data

We may also create aggregated anonymized information from the personal information we collect, by removing data that makes the information personally identifiable to you. As this aggregated anonymized information cannot be used to identify you, it is not considered “personal information,” and we may freely use it and share it with third parties for any business or other purpose not prohibited by applicable law.In cases where our use or sharing of data does not require an ability to identify individuals from the data, we may de-identify that data as a way of protecting privacy and security. Where the process is designed to permanently de-identify the data, we will maintain and use the data only in a de-identified form and will not to attempt to re-identify it (except for the limited purpose of testing or evaluating the efficacy of the de-identification process or as otherwise permitted by law).

Service Providers

We may employ independent contractors, vendors, and suppliers (collectively, “service providers”) to provide specific services and products related to our website, content, and offerings, such as payment processing, fraud screening, and IT hosting, development, and support. Through our website, you may be given the opportunity to purchase (or to obtain more information regarding) certain content, products, or services that are sold through a company other than us (collectively, “third-party sellers”). We will try to make it clear to you when you are dealing with a third-party seller. You do not need to submit this information or purchase any products or services from third-party sellers to access our website or offerings. 

Third-Party Partners

We may share your personal information with third parties that we have partnered with to jointly create or offer a product, service, or joint promotion, to facilitate mold-related services, or for academic or medical research (“third-party partners”). If you decide to obtain a product or service or participate in a joint promotion that is offered by us and these third-party partners, the information you provide will be shared between us and the partner. Their use of your personal information is governed by their own respective privacy policies, not this Privacy Policy. We may also share your information with these third-party partners in the event we suspect you are violating our Terms & Conditions or the law. 

Financial services & payment processing

When you provide payment data, for example to make a purchase, we will disclose payment and transactional data to banks and other entities as necessary for payment processing, fraud prevention, credit risk reduction, analytics, or other related financial services. Affiliates 

We enable access to personal information across our subsidiaries, affiliates, and related companies, for example, where we share common data systems or where access helps us to provide our services and operate our business.

The Labs, Pharmacies, Medical Groups, or their Providers

We facilitate information disclosure between you and the Medical Groups, Pharmacies, Providers, and Labs, as applicable, to enable them to provide services to you via the Service and to collect payment on their behalf.

Analytics, Advertising, and Social Media Platforms and Networks

Our website has features such as cookies, pixels, and similar technologies that are used to track your activity on our website and other websites that you visit. Information gathered through these technologies is shared with third-party web analytics providers, advertising networks, and social media platforms. We share information, including sensitive personal information to the extent it is not Protected Information, with these third parties to understand how users interact with our website and provide you with advertisements that we or these third parties believe will be relevant. 

Third party analytics and advertising companies also collect personal information through our website and apps including identifiers and device information (such as cookie IDs, device IDs, and IP address), geolocation data, usage data, and inferences based on and associated with that data, as described in our Cookies Policy. These third-party vendors may combine this data across multiple sites to improve analytics for their own purpose and others. Laws and Legal Rights

We may disclose personal information if we believe, in good faith, that we are required to do so to comply with the law, a subpoena, a search warrant, a court or regulatory order, or other valid legal process. Sale of Business

Personal information and other information may be shared in the diligence process with counterparties and others assisting with the transaction and transferred to a successor affiliate as part of that transaction.

Our website contains links to other websites not owned or operated by Moldco. We will attempt to make it obvious to you when you leave our website and enter these websites by opening a new browser tab or otherwise notifying you that you are leaving our website. However, we are not responsible for the privacy practices of such websites. We encourage you to read the privacy policies or statements of each website. This Privacy Policy applies solely to information collected by our website and offerings.

INFORMATION SECURITY

We maintain reasonable technical and organizational measures to protect personal information from loss, misuse, alteration, or unintentional destruction. We have implemented various security measures to protect both the personal information and the general information that we receive from you through our website and offerings.

Notwithstanding the above commitments to protect your information, there is always some risk involved in transmitting information over the Internet. There is also some risk that others could find a way to thwart our security systems. As a result, while we strive to protect your information, we cannot ensure or warrant the security and privacy of any information you transmit to us, and you do so at your own risk.

YOUR RIGHTS AND CHOICES

You have rights and choices with respect to your personal information, and in some jurisdictions, these rights and choices may be enforceable under applicable law.

You may change your communication preferences, edit your profile information, “opt-out” of receiving email communications, and delete your Moldco account by contacting us at privacy@moldco.com or by selecting the options within your Moldco account.  

Access and portability

If you wish to access, copy, and/or download  personal information about you that we hold, please contact us at privacy@moldco.com using the email address tied to your account. 

Correction and deletion

You can update some of your personal information in your account, and you can delete it by closing your account. Please note that there may be legal reasons for us to keep your personal information, such as if we receive a law enforcement request asking us to preserve data. You can also request us to update or delete your personal information or account by contacting us at privacy@moldco.com.

Objection to processing

You can ask us to stop using your personal information for certain purposes, including using it to send you marketing communications, by contacting us at privacy@moldco.com. If you opt out of marketing messages from us, we may still send you updates about your account and purchases.

Targeted advertising and browser/device controls

You may set your browser to reject new cookies or web beacons or notify you when you receive a new cookie. Most browsers offer instructions on how to do so in the “Help” section of the toolbar. Please note that if you do not accept cookies, you may not be able to use certain features or resources of our website or Platform.

Data Retention

Moldco retain personal information for as long as necessary to provide the services and fulfill the transactions you have requested, comply with our legal obligations, resolve disputes, enforce our agreements, and for other legitimate and lawful business purposes. Because these needs can vary for different data types in the context of different services, actual retention periods can vary significantly based on criteria such as user expectations or consent, the sensitivity of the information, the availability of automated controls that enable users to delete data, and our legal or contractual obligations.

Transactions

In connection with any transaction that you conduct through the Service (e.g., the purchase or sale of any products or services on or through the Service), you may be asked to supply certain information relevant to the transaction, including, without limitation, your credit card number and expiration date, your billing address, your shipping address, your phone number and/or your email address. By submitting such information, you grant Moldco without charge the irrevocable, unencumbered, universe-wide, and perpetual right to provide such information to third parties (e.g., payment processing companies, buyers on the Service, sellers on the Service) for the purpose of facilitating the transaction.

All credit card, debit card and other monetary transactions on or through the Service occur through an online payment processing application(s) accessible through the Service. This online payment processing application(s) is provided by Moldco’s third-party online payment processing vendor, Stripe (“Stripe”) (“Payment Vendors”). Additional information about Moldco Payment Vendors, their respective privacy policies and information security measures ( the “ Payment Vendor Policies”) should be available on the Stripe website located at https://stripe.com/ or by contacting Stripe directly. Reference is made to the Payment Vendor Policies for informational purposes only and are in no way incorporated into or made a part of this Privacy Policy. Moldco’s relationship with Payment Vendors, if any, is merely contractual in nature, as Payment Vendors are nothing more than a third-party vendor to Moldco, and they are in no way subject to Moldco’s direction or control; thus, their relationship is not, and should not be construed as, one of fiduciaries, franchisors-franchisees, agents-principals, employers-employees, partners, joint venturers or the like.

JURISDICTIONAL ISSUES

The Service may only be used within certain states within the United States as described in our Terms and Conditions. Accordingly, this Privacy Policy, and our collection, use, and disclosure of information about you, is governed by U.S. law.

You have a right to see the personal information we have collected about you. You may request your personal information by contacting us at privacy@moldco.com. You also have a right to request additional information about our collection, use, disclosure, selling, or sharing of such information. 

Rights to Request Correction or Deletion

You also have the right to request that we correct inaccurate personal information about you or delete your personal information. You can update your personal information or delete your data from within your Moldco account or by contacting us at privacy@moldco.com. Please note that there may be legal reasons for us to keep your data, such as if we receive a law enforcement request asking us to preserve data.

Right to Opt-Out/Right to Limit Use and Disclosure of Sensitive Personal Information

You have a right to opt out of the “sale” or “sharing” of your personal information. You also have a right to limit our use of sensitive personal information for purposes other than to provide our services. As a health related service, the information we collect often pertains to your health. Please contact us at privacy@moldco.com if you do not wish for us or our partners to share information relating to you for marketing and advertising purposes.

Right to Opt-Out / “Do Not Sell or Share My Personal Information”

You have a right to opt-out from future “sales” or “sharing” of personal information as those terms are defined by the CCPA.

Note that the CCPA defines “sell,” “share,” and “personal information” very broadly, and some of our data sharing described in this Privacy Policy may be considered a “sale” or “sharing” under those definitions. In particular, we let advertising and analytics providers collect identifiers (IP addresses and cookie IDs), activity data (browsing, clicks, non-product identifying transaction data), device data, and geolocation data through our sites when you use our online services, but do not “sell” or “share” any other types of personal information. If you do not wish for us or our partners to “sell” or “share” personal information relating to your visits to our sites for advertising purposes, you can make your request by emailing privacy@themoldco.com. If you opt-out using these choices, we will not share or make available such personal information in ways that are considered a “sale” or “sharing” under the CCPA. However, we will continue to make available to our partners (acting as our service providers) some personal information to help us perform advertising-related functions. Further, using these choices will not opt you out of the use of previously “sold” or “shared” personal information or stop all interest-based advertising.

Authorized Agents

You may designate, in writing or through a power of attorney, an authorized agent to make requests on your behalf to exercise your rights under applicable State privacy laws. Before accepting such a request from an agent, we will require the agent to provide proof you have authorized it to act on your behalf, and we may need you to verify your identity directly with us.

Right Against Discrimination

Moldco will never discriminate against you for exercising these rights. You may designate, in writing or through a power of attorney, an authorized agent to exercise these rights on your behalf. Before accepting such a request from an agent, we will require the agent to provide proof you have authorized them to act on your behalf, and we may need you to verify your identity directly with us.

Lastly, under California Civil Code section 1798.83, also known as the “Shine the Light” law, California residents who have provided personal information to a business with which they have established a business relationship for personal, family, or household purposes may request information about whether the business has disclosed personal information to any third parties for the third parties’ direct marketing purposes.
